Common Violations Cited in Examination Reports
The Commissioner may, by order, deny, suspend, revoke, or refuse to issue or renew a license of a licensee or applicant for violations of the Mortgage Licensing Act or may restrict or limit the activities relating to mortgage loans of any licensee or any person who owns an interest in or participates in the business of a licensee.
The Commissioner may, by order, impose a civil penalty upon a licensee or any partner, officer, director, or other person occupying a similar status or performing similar functions on behalf of a licensee for any violation of the Mortgage Lending Act. The civil penalty shall not exceed twenty-five thousand dollars ($25,000) for each violation of the Mortgage Licensing Act by a mortgage broker, lender or servicer. The Commissioner may impose a civil penalty of up to twenty-five thousand dollars ($25,000) for each violation of the Mortgage Licensing Act by a person other than a licensee or exempt person.
